TERMS AND CONDITIONS OF SALE AND USE
ARTICLE 1. SCOPE OF APPLICATION
The general conditions of sale detailed below (hereinafter referred to as the "General Conditions"), govern the contractual relationship between any user of the website www.courts-tirages.com (hereinafter referred to as "User" or "You") and the commercial sign Les Courts Tirages® belonging to the company Les Courts Tirages SAS with a capital of 15 000 € registered in the RCS of Angoulême under the number 514606169 domiciled at 51 avenue Maryse Bastié 16340 L'Isle-d'Espagnac.
These general terms and conditions of sale are the only ones applicable and replace all other conditions, unless prior, express and written derogation.
Les Courts Tirages can be punctually brought to modify some of the provisions of its general conditions, so it is necessary that they are reread before each visit to www.courts-tirages.com (hereinafter referred to as the "Site").
These modifications are opposable from the moment they are put online (30/11/2019) and cannot apply to contracts concluded previously. Each purchase on the Site is governed by the general terms and conditions applicable on the date of the order.
By validating your order, you unreservedly accept the General Terms and Conditions of the moment after having read them. By accessing the Site, you agree to abide by these terms and conditions.
It is specified that these conditions govern the sales of products of Les Courts Tirages on the Site.
ARTICLE 2. USE OF THE SITE
To use the Site, you must be at least 18 years of age, be legally capable of entering into and using this Site in accordance with these Terms and Conditions.
You guarantee the truthfulness and accuracy of the information provided by you on this Site.
Les Courts Tirages reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.
The Site is available in French language.
1. Essential characteristics of the products
The products sold on the Site are certified Fine ART or Digigraphy prints, boxes of fine art prints or any other product manufactured and offered by Les Courts tirages.
These artistic creations are the expression of the creativity of authors and book publishers.
The prices of our products are indicated in euros all taxes included (VAT + other taxes) except participation by the purchaser in the costs of processing and shipping.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned.
Customs duties or other local taxes or import duties or state taxes may be payable.
These duties and sums are not covered by the jurisdiction of short runs. They will be at your expense and are your sole responsibility, both in terms of declarations and payment to the authorities and/or competent bodies of your country. It is essential that you obtain prior information on these particular aspects from the competent authorities.
Les Courts Tirages reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of the recording of the orders, subject to availability.
The products remain the property of company Les Courts Tirages until full payment of the indicated price.
2. Placing an order
To place an order, you must at least go through the following steps:
- Consultation of the sheet presenting the product. You must click on "Add to basket" to add this item to your basket.
- Cart" screen: you can consult the list of selected creations and delete an item or change the quantities ordered at any time.
- Identification or customer account creation screens.
- Screen for choosing a delivery method. On this screen a link is proposed to you to change the articles of your order.
- Summary and payment choice screen. This screen allows you to choose your method of payment and to check the different elements of your order (items, quantities, delivery method, total price). You must make sure that all these elements are in accordance with your request. Thanks to the links on this screen, you have the possibility to modify your order.
- You must then accept these general terms and conditions of sale and use of the Site in order to proceed to the payment stage. The conditions are available for reading and printing from the link entitled "general terms and conditions of sale". Their acceptance is made by checking the box attached to the proposed link. The general terms and conditions of sale and use of the Site must be accepted with each order.
- You pay for your order by the means of payment chosen among those indicated.
- The contract is only concluded upon confirmation of payment by the bank.
- The Site will send you an order confirmation on your e-mail within a few minutes.
3. Means of payment
The payment of your purchases is made by credit cards: Visa, MasterCard.
4. Payment security
For credit card payments, the transaction is carried out using the Stripe payment platform on the Squarespace platform.
The User's banking data is encrypted (SSL technology, Secure Socket Layer).
They do not circulate unencrypted on the Internet.
Your bank details (card number, expiration date) are not communicated to the company Les Courts Tirages.
5. Proof
The data recorded by the Site constitutes proof of all transactions between the Site and its customers.
The data recorded by the Stripe payment system constitutes the one and only admissible proof of the financial transactions carried out.
6. Processing and delivery of orders
Orders, placed from Monday to Friday excluding public holidays, are shipped within 48 hours subject to manufacturing lead times for certain products.
7. Delivery address
Les Courts Tirages delivers in metropolitan France. These deliveries are ensured by the carrier Colissimo or Chronopost.
The products are delivered to the delivery address you specify during the ordering process, this address may be different from the billing address. The delivery deadline is dependent on and corresponds to:
- the shipping time indicated on the item sheet, to
which is necessarily
added - the processing and delivery time.
Changing the delivery address after the order has been placed is in principle no longer possible for logistical reasons.
However, you can contact us by e-mail or telephone if you wish to change your delivery address. We will then study the possibilities offered according to your order.
8. Delivery methods and deadlines
The possible delivery methods depend on the quantity, the size of the article(s) ordered and the country of delivery.
If your order includes articles of different sizes, the size of the largest article is taken into account.
Les Courts Tirages reserves the right to choose the carrier.
The respect of delivery deadlines depends on the carrier. Consequently, no claim for compensation, of any nature whatsoever, can be invoked or claimed by the customer.
9. Shipping
costs Shipping costs vary according to the country and the delivery method as well as the number and format of the works ordered.
10. Receipt of delivery
When you receive your order, it is your responsibility to open the parcel to check that the prints are in good condition.
If you do not personally receive the parcel, ask the person in charge of receiving the parcel to carry out this check.
In the event of a problem, please give your parcel to the delivery person (La Poste or private carrier), stating the problem encountered, and contact our customer service department on the same day.
Do not sign the delivery note if the order has arrived damaged. No complaint will be accepted if the delivery note has been signed.
In the case of a delivery by a private carrier, the carrier is not obliged to deliver inside your home and may hand over the parcel at the entrance of your building or house.
Receipt of the transported objects extinguishes any action against the carrier for damage or partial loss if, within three days, not including public holidays, following receipt, the recipient has not notified the carrier, by extrajudicial act or by registered letter, of his protest, which must be substantiated. (Art. L 133.3 of the Commercial Code).
11. Right of withdrawal In accordance
with the legal provisions in force, you, as a private individual, have a general right of withdrawal to return the work that does not suit you. This right does not apply to orders placed by companies.
For any order on the Site, you have a period of 7 days from the effective passage of the order to exercise your right of withdrawal from the company Les Court Tirages without having to justify any reason or pay a penalty.
To do so, please contact our customer service who will give you the return address and you will then have a period of 10 days to return your order in its original packaging.
- If your order was delivered by the Post Office (Colissimo-Chronopost), you can return your order by post (return costs at your expense).
- If your order was delivered by a carrier, he will pick up your order. This service will be billed to you at the same price as the initial delivery costs.
No C.O.D. shipment will be accepted for any reason whatsoever.
The company Les Courts Tirages will reimburse the price of the returned items as well as the initial shipping costs minus the penalties (the return costs remain at your expense) within 15 days of receipt by the company Les Courts Tirages, by crediting the bank account used for payment.
12. Right of return
In the event that the works received do not conform to the order, you have a right of return. In this case, please contact our customer service who will give you the address and the return modalities.
Les Courts Tirages will exchange the damaged item, within the limits of available stocks.
In the case of exercising the right of return and only in this case, the return and new shipment costs remain the responsibility of the company Les Courts Tirages.
13. Customer service and complaints
For any information or question, our customer service is at your disposal, from Monday to Friday, from 9:30 am to 1:00 pm and from 2:00 pm to 6:00 pm, (from France) 00 33 5 45 37 40 40 in order to give you all the information you would like about our works and your order.
ARTICLE 3. FORCE MAJEURE
Pursuant to Article 1148 of the Civil Code, Les Courts Tirages cannot be held responsible or considered as having committed a fault in the processing of your file, if any delay or non-performance is the result of a case of force majeure.
ARTICLE 4. NOMINATIVE INFORMATION
The automated processing of personal information has been declared to the Commission Nationale de l'Informatique et des Libertés under the number 1280165.
The information and data concerning you, necessary for the management of your order and for our commercial relations, may be transmitted to the companies contributing to these relations such as those in charge of the execution of services and orders, for their management, execution, processing and payment.
This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable us to personalise the services we offer you and to improve the quality of the information we send you.

1) Rights on the work
The artist, for having taken the initiative of his creation, remains the owner of the copyright on his creation, within the meaning of French law.
The rights of representation and reproduction of the works present on the site www.courts-tirages.com belong to their authors and the company Les Courts Tirages.
Their joint authorization is necessary for any exploitation of these rights.
For this reason and in accordance with the provisions of the code of intellectual property, only the use for private use subject to different or even more restrictive provisions of the code of intellectual property is authorized.
2) Intellectual

This contract is subject to French law. It is available in the language in which the site is consulted, or in English, cf. art. II. In the event that a dispute arises from the present contractual relationship, the user and the company Les Courts Tirages commit before any legal action to seek an amicable solution.
In case of dispute, only the French courts will be competent to be seized.
